MoneyUp Academy Terms of Use
The MoneyUp Academy is a Capitec initiative to promote consumer education. These terms will apply to all your activities on the MoneyUp Academy website as well as other MoneyUp Academy services. By making use of the Website/Platform/Course as defined herein below, you are acknowledging that you have read these Terms of Use, as updated from time to time, together with the attached privacy policy, that you understand them and that you agree to be bound by and comply with them.
1. Definitions
1.1 “Account” shall mean the username and password required for you to register for a Course and which will be linked to all your Activities. You may only have one active Account at any point in time.
1.2 “Activities” shall mean all interactions with the Courses and the Platform;
1.3 “Content” shall mean the information found on the Website describing the Courses and Activities.
1.4 “Course(s)” shall mean the advertised Course(s) on the Website from time to time, including all content inherent in and forming part of such Courses;
1.5 “Company” shall mean Capitec;
1.6 “Capitec” means Capitec Bank Ltd [Registration Number: 1980/003695/06], a public company duly incorporated in terms of the Companies Laws of South Africa with its registered address at 5 Neutron Road, Techno Park, Stellenbosch and its affiliates, subsidiaries, holding companies, partners, employees, officers, servants or agents and the terms “we”, “us”, “our” when used herein means the Company.
1.7 “MoneyUp Academy” means the consumer education e-learning platform hosted by Capitec;
1.8 “Platform” shall mean the MoneyUp Academy platform on which the Courses, Activities and Content will be made available to the User, which platform is hosted on the Website;
1.9 “Website” shall mean www.moneyup.co.za;
1.10 “User” or ”you” shall mean you, the person reading these Terms and/or making use of the Website/Platform/Course(s).
2. Accounts
2.1 If you wish to make use of the Platform, Capitec will require you to register an Account to enable you to access the Courses and participate in Activities;
2.2 You may only have one active Account at any point of time;
2.3 To create an Account, You must:
2.3.1 be over the age of 18 (eighteen);
2.3.2 provide accurate, correct and complete information about yourself;
2.3.3 have a verified email address, which may only be linked to a single account.
2.4 You are solely responsible for the Activities linked to your Account and are further responsible for maintaining your Account as well as the safekeeping of your password;
2.5 Accounts cannot be transferred from one User to another;
2.6 Accounts will further be closed if either Party terminates the relationship by giving notice of termination to the other Party or upon the death of the User. Capitec reserves the right to discontinue the MoneyUp Academy and/or the Platform at any time, at its sole discretion with immediate effect, and to take down the service without notice;
2.7 You are responsible to notify us if someone gained unlawful access to your Account;
2.8 Capitec may contact you in relation to your Account activities on the email address supplied by You.
3. Disclaimer
3.1 The information, ideas and opinions expressed on the Website are of a general nature and should not be regarded as financial or other advice. The Platform is specifically aimed at educational development. Prior to taking any action based on, or in relation to, information, ideas and opinions expressed on this Website you should consider obtaining professional advice appropriate to your planned action.
3.2 Capitec cannot be held responsible for any errors and/or omissions in any of the Course materials and Activities on the Website.
3.3 Capitec will not, under any circumstances, be liable for any costs, claims or damages that you may sustain or suffer as a result of accessing the Platform or the Website, creating an Account, or registering for and/or participating in any Course or Activity, or any actions that you may take as a result of such access, registration or participation. Under no circumstances do we guarantee your suitability for a particular Course based on the levels of difficulty.
4. Usage
4.1 Capitec reserves the right to change, modify, add or remove portions or the whole of these terms and conditions from time to time;
4.2 Information contained on the Website does not constitute advice and you as the User should consult the relevant professional advisor before acting on any information on the Website;
4.3 When you successfully register on the Website you will be given a limited, revocable and non-exclusive right to use the Platform, the Course, the Content and the Activities, solely for your personal, non-commercial and educational purpose; any other usage is prohibited;
4.4 You may not reproduce, redistribute, assign, sell, edit, create derivative works of, sublicense, or otherwise transfer any Website or Course content;
4.5 The duration of access to the Website, Platform, Activities, Content and/or Courses shall be at Capitec’s discretion;
4.6 Capitec may, at any time and in its sole discretion, terminate your access and usage of the Platform if it determines that your use of the Website, Platform, Activities, Content and/or Courses are not in accordance with these Terms of Use as updated from time to time;
4.7 You may not access or use the Activities, Platform, Courses or Content or create an Account for unlawful purposes;
5. Intellectual property and copyrights
5.1 The Website, Platform, Content and/or Courses, including software source code, are the property of or licensed to Capitec and all
intellectual property rights vests in Capitec and/or its licensors.
5.2 Unauthorised copying of the Platform, Courses, Content, information, software and or file(s) or attempt of copying is expressly prohibited.
6. Applicable law
6.1 These Terms of Use have been concluded in the Republic of South Africa (“RSA”) and as a result shall be governed by and construed in
accordance with the laws of the RSA and the jurisdiction of the RSA courts.
